Bookings between David Ash and Heather Ash (hereinafter called “The Owners”) and the person making the booking (hereinafter called “The Client”) can be made by telephone, fax, mail and email and be held for up to 7 days, pending receipt of the completed booking form and the deposit. Reservations are only binding once the following terms are adhered to:

a) The booking form has been fully completed, signed and received by the owners
b) The Client has paid a deposit of £150 / $260
c) The Client is a member of the party occupying the property and does so to confirm he/she abides by the conditions for booking on behalf of all persons included on the booking form, including those added at a later date.
d) The Client is at least 21 years of age
e) The booking is not for an all male party
f) The booking has been confirmed to the client in writing

The property cannot be sublet, shared or assigned. Only the persons shown on the booking form are permitted to stay in the property.

Balance Payment
The balance must be paid in full 10 weeks prior to the commencement date of the rental period.

In the event that the outstanding balance has not been paid 10 weeks prior to the commencement date of the rental period, the owners reserve the right to cancel the booking and retain the deposit payment.

If bookings are being made within 10 weeks of the commencement period of the rental period then the full amount will be payable at the time of booking.

Cancellation
In the event that you cancel your booking, for whatever, reason, the following charges will apply:-

More than 10 weeks Full Deposit

5 – 10 weeks 50% of the rental charge

0 – 5 weeks 100% of the rental charge

In the unlikely event that circumstances beyond the owners’ control cause the cancellation of the rental agreement, the owners reserve the right to cancel the booking at any time without penalty and will only be liable to refund all monies already paid by the client.

Rental Charges
Rental charges are inclusive of electricity, gas, water, cable TV, local telephone charges and Sales and Resort Taxes.

Force Majeure
The owners accept no responsibility or liability whatsoever for any loss or damage or alteration to the terms of the booking caused by events beyond our control, war, civil commotion, terrorism, flight delays or cancellations, adverse weather conditions, fire, flood or industrial dispute.

Security Deposit
On arrival, our management company will collect a security deposit of $275 using credit card details. Once the villa has been vacated, if any loss or damage has occurred during the rental period, you will be notified and the appropriate payment will be charged to your credit card. In the unlikely event that security deposit does not cover the cost of any damage, the client will be invoiced accordingly.

Access
The property will be available from 4pm local time on the day of arrival and must be vacated by 10am local time on the day of departure.

The Client will be provided with a front door key for the villa, the loss of which will result in a replacement charge of $150 that will be deducted from the security deposit.

Liability
The owners do not accept any liability for injury, death, damage or loss caused to persons or personal effects by any reason or any claim made as a result of this booking and the stay at our villa through the rental period. The client is responsible for obtaining insurance policies to cover all risks. This waiver is also applicable to people visiting the property as guests of the client.

The owners do not accept any liability for injury, death, damage or loss caused to persons or personal effects for any such claim by a third party as a consequence of actions by the client(s) and other people occupying the property during the rental period.

It should be noted that the villa has a swimming pool and spa and the owners and Management Company do not accept liability for injury or death, howsoever caused, as a result of using the pool or spa. Clients are specifically asked to supervise children at all times. Clients should exercise caution on wet surfaces.

Pets
Under no circumstance are pets allowed into the property.

No Smoking
We politely ask you to refrain from smoking inside the property.

Brochure Descriptions
All villa and resort descriptions are in good faith and every care is taken to ensure their accuracy, but no liability will be accepted in the event of an error.
